Oklahoma father pleads guilty to mistakenly shooting son
DELAWARE COUNTY, Okla. — Tony Rutherford was accused of shooting his 13-year-old son about a mile from their home in Delaware County, Oklahoma on April 7th, 2018.
Investigators say Rutherford shot at someone who was driving his older son’s pickup truck, reportedly believing the driver was a thief. The truck crashed and Rutherford discovered the driver was his 13-year-old son, Kyle. He died at the scene of a gunshot wound.
Rutherford was originally charged with murder, but pleaded guilty to manslaughter. On December 20th, 2018, a judge sentenced Rutherford to 60 days in county jail starting after the holidays. After he serves that time, he’ll be on a 10 year deferred sentence.
