Officer involved fatal shooting under investigation in Labette County

UPDATE: The Kansas Bureau of Investigations is looking into an officer involved shooting. The man fatally shot was identified as 38-year-old Scott Souders.

Chetopa, Kansas Police had received information that there could be possible drug activity at a home at 1110 Cherry Street. Further investigation led them to get a search warrant for the property.

Police officers got to the home on August 12th around 12:15 am.

The KBI says preliminary investigation indicates that after knocking and announcing their presence several times, three officers entered the home.

According to the KBI, they moved through the house to try to safely determine if anyone was inside.

As the first officer inside the house made his way down the hallway, he encountered an armed man and fired three shots.

All officers left the home and took cover. The Labette County Sheriff’s Office responded to help.

Once they were outside the home, officers called for the occupants of the house to come out. Soon after, authorities say a 25-year-old female exited.

She told officers that the only other person still inside the home was the man previously encountered and that he needed medical attention.

According to the KBI, police went back into the home and found the man, later identified as Souders, suffering gunshot wounds. A rifle was found near him.

EMS responded and declared Souders dead at the scene. He lived at the home.

No law enforcement officers were injured during the incident.

The Labette County Sheriff’s Office requested KBI assistance around 12:20 am.

The KBI says it will conduct a thorough and independent investigation into the incident. Findings will be turned over to the Labette County Attorney for review.


Authorities investigate a fatal shooting in Chetopa, Kansas.

Labette County Sheriff Darren Eichinger says it happened early this morning. The Kansas Bureau of Investigations is taking over the case and will release any further information.

Sheriff Eichinger did confirm that officers were trying to serve a warrant in the 1100 block of Cherry Street when the shooting happened.

One person has died. Authorities did not confirm the identity of that person, but did tell KOAM it was not an officer. He would not confirm if authorities fired a shot.
