Former County Assistant Attorney charged with DUI, battery on LEO
MONTGOMERY COUNTY, Kan. – A local former assistant county attorney faces charges after an alleged DUI incident in June.
The Montgomery County Prosecutor’s Office on Monday filed charges against Daylene B. Walls. Those charges are:
- Driving under the influence of drugs/alcohol; 1st conv; Incapable of safe driving (First offense)
- Battery on LEO; Physical contact with county or city officer on duty
- Interference with LEO
According to court documents, all three charges are misdemeanors.
Walls was a Montgomery County assistant prosecuting attorney in the juvenile division at the time. She is no longer listed in that position.
Special Prosecutor David Yoder out of Newton, Kansas is prosecuting the case against Walls.
Alleged DUI Incident
The DUI incident happened on June 13, 2022. According to the Montgomery County Sheriff’s Office, around 10:29 pm, someone reported a vehicle in a ditch.
Montgomery County Dispatch took the report of a female stumbling out of the vehicle in the ditch and of another stopped vehicle. The caller told Dispatch that when they stopped to check on the people, they said they did not want police assistance.
Patrol deputies responded to US Highway 160 and US Highway 75 west of Independence, Kansas.
After arriving, they spoke with the female driver and identified her as 65-year-old Daylene Walls of Independence. The other individual was her friend.
According to the Sheriff’s Office, Deputies got evidence of Walls being under the influence of alcohol. Authorities say deputies tried to conduct their investigation of DUI, but allege Walls would not comply.
A Sheriff’s Office press release states, “Deputies attempted to take Walls into custody for suspicion of DUI, but Walls started refusing to place her hands behind her back. Walls at one point slapped the Deputy and repeatedly told them she was not going to jail. Deputies were able to place Walls in custody without further incident.”
Authorities also arrested her male friend for interference with an investigation. They say he argued with deputies, allegedly trying to prevent them from arresting Walls. However, as of Aug. 16, 2022, court records do not show any official charges filed against him.
Deputies got a search warrant for Walls’ blood-alcohol levels.
